Terms of Service

Terms of Service

  • Welcome to Inland Empire (IE) Fence and Construction, Inc. (“IE Fence,” “Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern all services provided by IE Fence, including through our website www.iefence.com and any related digital communications. By engaging with us or using our website, you (“Client,” “you”) agree to the terms below.

1. Services Offered

IE Fence provides fence installation, repair, and fabrication services to residential, commercial, and public clients throughout Southern California. All services are outlined in individual proposals or project-specific agreements.

2. Estimates & Proposals

Written proposals include a defined scope of work, estimated cost, and payment schedule. Pricing may be subject to change based on material costs or site conditions until a contract is signed and a deposit is received.

3. Deposits & Payment Terms

A standard deposit of 10% is required before material procurement or scheduling. Final payment is due upon project completion unless otherwise stated. We accept payment via:

  • Zelle (ar@iefence.com)
  • Check (mailed to 599 S Barranca Ave, L102, Covina, CA 91723)
  • Credit card (via phone, +3.5% processing fee)

4. Scheduling & Delays

Project scheduling begins after receiving the signed proposal and deposit. Estimated timelines are subject to change due to weather, site conditions, or vendor delays. We will notify you of any significant changes.

5. Change Orders

Any change to the original scope (materials, dimensions, added work) requires a written change order, which may affect cost and schedule. Verbal agreements are not binding.

We implement appropriate technical and organizational measures to protect your data from unauthorized access, disclosure, or misuse.

6. Permits & Approvals

We will obtain permits only if explicitly included in your proposal. The client is responsible for HOA approvals, zoning compliance, or any other site-specific permissions unless otherwise agreed.

7. Client Responsibilities

You agree to:

  • Provide clear site access during scheduled work hours.
  • Remove obstacles, personal items, and secure pets.
  • Notify us of underground utilities or hazards. We are not liable for issues caused by undisclosed or unmarked site conditions.

8. Warranty

We offer a limited 1-year workmanship warranty, unless otherwise noted. This warranty excludes:

  • Damage from weather, soil movement, accidents, abuse, or neglect.
  • Modifications or repairs not performed by IE Fence. Manufacturer warranties on materials apply where available.

9. Cancellations

If a project is canceled after deposit, IE Fence reserves the right to retain all or part of the deposit, especially if custom fabrication has begun or materials have been ordered.

10. Communication Consent (Text & Email)

By submitting your information through our website or otherwise contacting us, you consent to receive updates via SMS and/or email. Message and data rates may apply. To opt out, reply “STOP” or email us directly.

11. Privacy

We value your privacy. Information collected is used strictly to provide services, respond to inquiries, or send project updates. See our Privacy Policy for full details.

12. Limitation of Liability

To the extent allowed by law, IE Fence shall not be liable for incidental, indirect, or consequential damages. Our liability for claims is limited to the amount paid by you for services rendered.

13. Indemnification

You agree to indemnify and hold harmless IE Fence, its employees, and subcontractors from any claims, damages, or liabilities arising from:

  • Your direction on site,
  • Use of client-supplied plans/materials,
  • Site-specific risks not disclosed to us.

14. Force Majeure

We are not responsible for delays or failure to perform due to causes beyond our control, including natural disasters, labor shortages, supplier failures, pandemics, or government actions.

15. Dispute Resolution

Disputes will first be resolved through informal negotiation. If unresolved, both parties agree to binding arbitration in Los Angeles County, CA under the rules of the American Arbitration Association.

16. Governing Law

These Terms and all related agreements are governed by the laws of the State of California.

17. Modifications

We may revise these Terms periodically. Any changes will be posted to our website with a revised effective date.
